By accessing or using the Foyer application ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
These Terms constitute a binding agreement between you and DarkTiger Studios LLC, the operator of Foyer ("Foyer," "we," "us," or "our").
Foyer is a web application that provides open-house operations tools for real estate agents and teams. The Service includes QR-code visitor check-in, lead capture and scoring, automatic CRM data delivery, seller summary report generation, team role management, and open-house analytics.
Foyer is not a CRM. Foyer captures and enriches open-house activity and routes data to the CRM platform you designate. We do not store leads as a permanent CRM system.

You are responsible for all activity that occurs under your account. Notify us immediately at hello@foyeroh.com if you suspect unauthorized access.
Foyer is offered on a subscription basis. New accounts begin with a 14-day free trial of Team-plan features; no payment method is required to start the trial, and nothing is charged unless you subscribe. Subscription fees are billed in advance on a monthly or annual cycle, depending on your selected plan. Payment is processed on the web by Stripe.
All fees are non-refundable except as required by applicable law or as explicitly stated in these Terms. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.
We reserve the right to change pricing with 30 days' notice to active subscribers. Continued use after a price change takes effect constitutes acceptance of the new pricing.
By using Foyer to collect visitor check-in data at your open houses, you represent and warrant that:

Foyer and all associated trademarks, logos, software, and content are the exclusive property of the operator. These Terms do not grant you any right to use our trademarks, trade names, or other proprietary materials.
You retain all rights to the data you create within the Service (open-house records, lead data, uploaded documents). You grant us a limited license to store and process that data solely to provide the Service.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
Lead scoring and offer projections are algorithmic estimates, not professional advice. We are not responsible for business decisions made based on Foyer's outputs.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FOYER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
You may terminate your account at any time by emailing hello@foyeroh.com or using the account deletion flow within the app.
We reserve the right to suspend or terminate your account immediately if you violate these Terms or if we have reason to believe your use of the Service causes harm to other users, visitors, or third parties.
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute arising under these Terms shall first be raised with us in writing so we can attempt to resolve it in good faith. If unresolved after 30 days, disputes shall be submitted to binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, seated in New York, except where prohibited by law or where either party seeks relief in small-claims court.
We may update these Terms from time to time. We will notify active account holders of material changes by email at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
